DMCA Copyright Policy

1. DMCA Compliance

LeadZ respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act ("DMCA") and will respond to properly submitted notices of copyright infringement.

2. Filing a DMCA Takedown Notice

If you believe content on our Service infringes your copyright, submit a DMCA notice containing:

Required Information

  1. Identification of copyrighted work: Describe the work you claim has been infringed. If multiple works, provide a representative list.
  2. Identification of infringing material: Provide URLs or specific location of the infringing content on our Service so we can locate it.
  3. Your contact information: Full name, address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Physical or electronic signature: Your physical or electronic signature.

3. Our Response to DMCA Notices

Upon receiving a valid DMCA notice, we will:

  1. Remove or disable access to the allegedly infringing content
  2. Notify the user who posted the content
  3. Provide them with a copy of your notice
  4. Inform them of their right to file a counter-notice

We typically act within 1-2 business days of receiving a compliant notice.

4. Filing a DMCA Counter-Notice

If you believe your content was wrongly removed, you may file a counter-notice. It must include:

Required Information

  1. Your contact information: Full name, address, telephone number, and email address.
  2. Identification of removed content: Description and location of the content before removal.
  3. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or the district where we're located if you're outside the US).
  5. Physical or electronic signature: Your physical or electronic signature.

5. Our Response to Counter-Notices

Upon receiving a valid counter-notice, we will:

  1. Forward a copy to the original complainant
  2. Inform them they have 10 business days to file a court action
  3. Restore the content after 10-14 business days if no legal action is taken

6. Repeat Infringer Policy

We will terminate accounts of users who are repeat infringers. A repeat infringer is:

  • A user who has received multiple DMCA notices
  • A user who has had content removed multiple times
  • A user whose counter-notices have been rejected by courts

Generally, three confirmed infringements result in account termination.

7. What Content is Covered

This policy applies to all user-generated content including:

  • Photos and images uploaded to jobs or invoices
  • Documents and files
  • Company logos and branding
  • Email and message templates
  • Custom form content

8. Fair Use

Before filing a DMCA notice, consider whether the use constitutes fair use under US copyright law. Fair use may apply to:

  • Commentary and criticism
  • News reporting
  • Teaching and education
  • Research
  • Parody

Fair use is determined case-by-case based on purpose, nature, amount used, and market effect.

9. International Copyright

While this policy is based on US DMCA law, we respect copyright globally. If you're outside the US, we'll still process your notice, but please provide the legal basis for your claim in your jurisdiction.

10. Trademark Claims

For trademark infringement claims, email trademark@lead-z.com with:

  • Description of your trademark
  • Registration information (if registered)
  • How the mark is being infringed
  • Location of infringing content

11. Limitations

We are a service provider under the DMCA safe harbor provisions. We:

  • Do not pre-screen user content
  • Do not actively monitor for infringement
  • Respond to valid DMCA notices only
  • Are not liable for user copyright infringement
  • Do not arbitrate copyright disputes

12. Misrepresentation

Under Section 512(f) of the DMCA, anyone who knowingly materially misrepresents that content is infringing may be liable for damages, including costs and attorney fees. Do not file false notices.
